(Update to GDPR Reg. UE 2016/679)
Although the Regulation takes precedence over national law, the mere existence and application of the GDPR however, coming from a different system (the European one) to the national one, does not automatically imply the abrogation of the national law that regulates the same subject.
The Legislative Decree 19/2003 is therefore not directly repealed and, on the contrary, maintains its regulatory force provided it is not in conflict with the GDPR, but it is nevertheless subject to a sort of reinterpretation in terms of GDPR.
- where there is no compatibility between the requirements of the Italian CdP (Italian LegislativeDecree 196/2003) and those of EU Regulation 679/2016, the CdP gives way to new European regulations: the national law must therefore be disapplied in favour of the GDPR;
- where there is compatibility between the two rules, the CdP (Italian LegislativeDecree 196/2003) shall remain applicable while continuing to lay down the law, even more specifically than the GDPR. This is also as a result of the provisions of the GDPR "Recital 10" which states that ". . . the Member States should remain free to maintain or introduce national rules in order to further specify the application of the rules of this Regulation". And again ". . . this Regulation also provides for a margin of manoeuvre for the Member States to specify their rules, also with regard to the processing of special categories of personal data".
The information is aligned with the EU Regulation 2016/679 also in compliance with what it prescribes so that users are easier to understand what data is managed by the Modusnovi Cultural and Musical Association (hereinafter the Modusnovi Association), in which way these data are used, and the rights of users on them.

The optional, explicit and voluntary sending of electronic mail to the institutional address of the ModusNovi Association (email@example.com), indicated in several parts on this site, entails the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message.
The optional, explicit and voluntary sending of the online information request form published in the "Contacts" section of this site involves the subsequent acquisition of personal data with reference to: name and surname, e-mail address.
The optional, explicit and voluntary submission of the online form of membership to the ModusNovi Association published in the section "About us / Association" of this site involves the subsequent acquisition of personal data with reference to: name and surname, place and date of birth, address, tax code, telephone number, email address.
The computer systems and software procedures used to operate this website acquire, during their normal operation, some data whose transmission is implicit in the use of Internet communication protocols. These data are used only to obtain anonymous statistical information on the use of the site and to check its proper functioning.
This category of data includes IP addresses or domain names of computers used by users who connect to the site or addresses in URI (Uniform Resource Identifier) of the resources requested. Examples of URIs are: a web address (URL), a document, an image, a file, a service to which a web address, an email address, etc.
These data are used only to obtain anonymous statistical information on the use of the site and to check its proper functioning. The data could also be used to establish responsibility in the event of hypothetical computer crimes against this site.
Where and how data is stored
The personal data provided by users and transmitted to us in the forms listed above, are collected at the Legal Headquarters of the ModusNovi Association, by means of computerized tools with telematic methods suitable to ensure security and confidentiality, are stored in databases and / or dedicated sections and used only to perform the service requested always and in any case within the normal institutional activity of the ModusNovi Association, are processed only by persons in charge of treatment belonging to the ModusNovi Association and are not communicated or disseminated, except for legal obligations, outside the Association itself.
We try to take all reasonable technical and administrative organizational measures to protect your personal data from loss, misuse, disclosure, alteration and / or unauthorized destruction. Unfortunately, no data transmission or storage system can guarantee absolute security. If the user has reason to believe that the security of his own data stored by us has been compromised and is no longer guaranteed, he must immediately notify our data processing manager using the institutional email address of the ModusNovi Association (firstname.lastname@example.org) or contacting directly the data processing holder at the Legal Headquarters of the ModusNovi Association (via Ferdinando Magellano 21, c/o Lawyer S. T. Zanoni, 20900 Monza MB - Italy).
The personal information of users, stored at the Legal Headquarters of the ModusNovi Association, will be kept by us until it is necessary or permitted in light of the purposes for which it was obtained and / or until the users to whom they refer do not request its final deletion.
In particular, the subjects to whom the personal data refers have the right at any time to obtain confirmation of the existence of such data and to know its content and origin, verify its accuracy or request its integration or updating or rectification (art. 7 of Italian Legislative Decree no. 196/2003), and to personally verify the storage and preservation.
In accordance with the same article, the user has the right to request, at any time, the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, and to oppose in any case, for legitimate reasons, to their treatment.

RIGHT TO THE IMAGE
The right to the image is a right of the personality (see Subjective right) protected both by the Italian Civil Code (art. 10) and by Italian Law no. 633 of 22 April 1941 on the protection of copyright (art. 96-97).
The image of a person may be exhibited or published only with his consent, unless the exhibition or publication is permitted by law (when the reproduction of the image is related to facts, events, ceremonies of public interest or held in public or is justified by scientific, educational or cultural purposes or the reputation of the person, the public office held or the need for justice or police) and provided that the exhibition does not harm the honor, reputation or even the decorum of the person.
